Terms of Service

By downloading, installing, or using the Phaze application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Phaze ("Company," "we," "us," or "our").

Phaze is a body transformation companion application that provides tools for tracking nutrition, hydration, movement, progress photos, and habit building. The App is available in free and premium subscription tiers.

Phaze is not a medical device and does not provide medical advice. The App is intended for general wellness purposes only. Always consult your healthcare provider before making changes to your diet, exercise routine, medication, or treatment plan.

You must be at least 13 years of age to use the App. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to update your information as necessary.

Phaze offers a free tier and a premium subscription ("Phaze Pro"). Phaze Pro is available as a monthly subscription at $6.99/month or an annual subscription at $49.99/year.

• Payment is charged to your Apple ID account upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends

You retain ownership of any content you create or upload through the App, including progress photos, notes, and personal data. By using the App, you grant Phaze a limited license to process this content solely for the purpose of providing the service to you.

If you choose to share milestone cards or other content generated by the App on social media or other platforms, you do so voluntarily and at your own discretion.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App, other accounts, or our systems
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to transmit harmful, offensive, or objectionable content
• Resell, redistribute, or sublicense the App or any of its features
• Use the App to provide medical advice or diagnose health conditions

The information provided through the App, including but not limited to nutrition tracking, hydration targets, and wellness guidance, is for general informational purposes only. Phaze does not diagnose, treat, cure, or prevent any disease or medical condition.

If you are using prescription medications, including but not limited to GLP-1 receptor agonist medications, you should follow the guidance of your prescribing healthcare provider. Phaze is a supplementary wellness tool and should not replace professional medical advice.

Individual results may vary. Any testimonials or success stories shared in connection with the App represent individual experiences and are not guaranteed outcomes.

The App, including its design, features, content, and underlying technology, is owned by Phaze and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, and limitations of liability.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHAZE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
